When a delayed bag counts as lost

Emirates does not publish a fixed day count for when a delayed bag becomes a lost one. It says only that it will reach out once tracing efforts are exhausted. Most international carriers reach that point around three to four weeks after a connecting itinerary comes up empty.

Compensation limits: domestic and Montreal Convention

On a US domestic segment, DOT rules cap an airline’s baggage liability at 4,700 USD per passenger. That figure is published on transportation.gov. Most Emirates tickets from the US are international, so the Montreal Convention limit applies instead.

That limit is 1,519 SDR per passenger, roughly 2,000 to 2,200 USD at current exchange rates. It has stood since 28 December 2024, the date of the last inflation adjustment.

The US Department of Transportation has fined Emirates 100,000 USD in the past. The airline tried to exclude valuables like electronics, jewelry and cameras from that limit, and it underpaid delay expenses.

The airline’s contract of carriage is now expected to track the treaty figure rather than a narrower house rule. Declare a higher value in advance for anything valuable; Emirates allows that for an extra fee.

Damaged bags

Damaged bag claims follow the same 7 day window from the moment you collect the case. Bring photos of the damage, and leave the case at the airport for inspection when you can.

Preventing the problem
